1. About these Terms

These Terms of Service ("Terms") govern your access to and use of WaveMaker (the "Service"), operated by WaveMaker ("WaveMaker", "we", "us", or "our"). By creating an account, claiming an artist profile, connecting a streaming service, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Who can use WaveMaker

You must be at least 13 years old (or the minimum age required in your country) to use WaveMaker. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. You are responsible for any activity on your account and for keeping your login credentials secure.

3. Accounts and artist profiles

You can use WaveMaker as a fan, as an artist, or as part of an artist's team. To claim an artist profile you must verify ownership of the corresponding Spotify artist account through the OAuth flow we provide. We may revoke a claim if we have reasonable grounds to believe it was made fraudulently or without the artist's authorization.

4. Acceptable use

You agree not to:

  • Inflate fan actions through bots, click farms, stream farms, swap groups, paid engagement schemes, or any other artificial means;
  • Impersonate an artist, label, or person you do not represent;
  • Upload or promote content you do not own or are not authorized to use, including music, artwork, photography, or video;
  • Use WaveMaker to harass, threaten, dox, or defraud other users;
  • Attempt to reverse engineer, scrape at scale, or interfere with the Service or its security;
  • Violate the terms of any connected third-party service (including Spotify) when interacting with it through WaveMaker.

We may suspend, restrict, or terminate accounts that violate these rules. Serious abuse may be reported to the affected streaming services and, where required, to law enforcement.

5. Your content

You keep ownership of the content you submit to WaveMaker (campaign copy, artwork, audio clips, comments, and similar material). By submitting content, you grant WaveMaker a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, adapt for formatting purposes, and distribute that content solely to operate, promote, and improve the Service. You represent that you have all rights necessary to grant this license.

6. Third-party services (Spotify and others)

WaveMaker integrates with third-party services such as Spotify to verify fan actions and surface artist data. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or behavior of third-party services, and we may add, change, or remove integrations at any time. WaveMaker is not endorsed by, sponsored by, or affiliated with Spotify.

7. Pricing and paid features

WaveMaker is currently free to use, including running launch campaigns during our early bird period. We may introduce paid plans, per-campaign fees, fan tipping, or other monetized features in the future. If we do, we will publish the pricing on our pricing page and require your explicit confirmation before charging you. Any future paid subscriptions will renew on their stated cadence until cancelled, and you can cancel at any time from your billing settings and retain access through the end of the paid period unless we state otherwise.

8. Intellectual property

The Service, including the WaveMaker name, logo, website, software, and all related materials we create, is owned by WaveMaker and protected by copyright, trademark, and other laws. Except for the limited rights expressly granted by these Terms, we reserve all rights.

9. Termination

You can stop using WaveMaker at any time by deleting your account from your settings page or by submitting a request through our data deletion form. We may suspend or terminate your access if you violate these Terms, if required by law, or if continuing to provide you the Service is no longer commercially reasonable. Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, and dispute resolution) will continue to apply.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE SPECIFIC RESULTS, CHART POSITIONS, STREAM COUNTS, FOLLOWER GROWTH, OR ARTIST INCOME.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAVEMAKER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR STREAMS, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $100.

12. Indemnification

You agree to indemnify and hold harmless WaveMaker and its team from any claims, damages, liabilities, and reasonable legal fees arising from content you submit, your violation of these Terms, or your violation of any rights of a third party.

13. Changes to the Service or Terms

We may modify the Service or these Terms at any time. If we make material changes to the Terms, we will give you reasonable notice (for example, by email or an in-app notice) before they take effect. Continued use of the Service after the changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of laws rules. The state and federal courts located in San Francisco County, California will have exclusive jurisdiction over any dispute that is not subject to mandatory arbitration or small claims court in your jurisdiction.
